مشكلة البحث :

مسألة الإنكار في مسائل الخلاف مسألة مهمة تحتاج إلى بيان وتوضيح لأن هناك من يرى الإنكار في مسائل الخلاف وهناك من لا يرى ذلك ، فما هو الضابط في الإنكار في مسائل الخلاف ؟

أهمية البحث :

1 - الإنكار في مسائل الخلاف موضوع علمي ذو صلة بأصناف من الناس كالقضاة والآمرين بالمعروف والناهين عن المنكر وطلاب العلم .

2 - هذا الموضوع يكشف الضوابط التي تحكم وتبين الإنكار في المسائل الخلافية ، ومتى يسوغ الإنكار فيها ؟ ومتى لا يسوغ ؟

3 - هناك من أساء استخدام قاعدة (لا إنكار في مسائل الخلاف) حيث يستدل بها فيما يوافق هواه ، الأمر الذي يترتب عليه مفاسد كثيرة ، فكان لا بد من توضيح متى يصح الاستدلال بها ؟ ومتى لا يصح ؟

4 - هذا الموضوع يكشف مقدار الاستيعاب الفقهي للخلاف ، سواء من حيث الاعتراف به أو التعامل معه .

أهداف البحث :

1 - بيان التعريف بشعيرة الأمر بالمعروف والنهي عن المنكر .

2 - بيان معنى الإنكار ومشروعيته ودرجاته .

3 - بيان التعريف بالمسائل الخلافية والاجتهادية .

4 - بيان الأسباب والآداب والضوابط التي يجب مراعاتها عند الخلاف .

5 - بيان أقسام المسائل الخلافية وحكم الإنكار فيها .

6 - بيان موقف المحتسب من الإنكار في المسائل الخلافية .

فروض البحث تساؤلاته :

1 - ماذا يقصد بالأمر بالمعروف والنهي عن المنكر وما مشروعيته وما أهميته ؟

2 - ما معنى الإنكار وما مشروعيته ؟

3 - ما تعريف المسائل الخلافية والاجتهادية ؟

4 - ما الأسباب والآداب والضوابط التي يجب مراعاتها عند الخلاف ؟

5 - ما أقسام المسائل الخلافية ؟ وما حكم الإنكار فيها ؟

6 - ما موقف المحتسب من الإنكار في المسائل الخلافية ؟

منهج البحث :

تتبع هذه الدراسة أسلوب المنهج الاستقرائي التحليلي التأصيلي وذلك بالرجوع إلى المصادر التي تناولت الموضوع ومحاولة فهم أبعادها وتحليل ومناقشة آراء العلماء فيها بغية الوصول إلى الحق .

أهم النتائج :

1 - معرفة الخلاف بين العلماء له أهمية كبرى والمطلع عليه يجني كثيرا من الفوائد .

2 - وقوع الخلاف بين العلماء راجع إلى أسباب قدر الله تعالى وجودها وليس ناتجاً عن زيغ أو هوى .

3 - القول الصحيح أن قضية تصويب المجتهدين وتخطئتهم ما عليه الأئمة أن الله تعالى حكم حكماً معيناً في المسألة المختلف فيها والحق واحد لا يتعدد ، فمن أصاب فله أجران ، ومن أخطأ فله أجر ، والإثم مرفوع عنه .

4 - المسائل التي لا يسوغ فيها الخلاف ينكر على من خالف فيها على القول الصحيح بل نقل الإجماع على ذلك .

5 - المسائل التي يسوغ فيها الخلاف لا إنكار فيها على الصحيح وسبيلها المناصحة والمباحثة والمناظرة .

6 - إذا كان المختلفون في بلد واحد وتحت ظل إمام واحد ، فإن الخلاف السائغ يرتفع بحكم الحاكم ويرجع المخالف عن مذهبه لمذهب الحاكم .

7 -الأولى أن تصاغ قاعدة (لا إنكار في مسائل الخلاف) بعبارة أخرى نحو (لا إنكار في مسائل الاجتهاد) .

8 - المحتسب في المسائل التي لا يسوغ فيها الخلاف إن كان القول الذي يعضده الدليل يوافق ما يراه فإن له الإنكار وإن كان القول الذي يعضده الدليل خلاف ما يراه فليس له الإنكار .

9 - ليس للمحتسب الإنكار في المسائل التي يسوغ فيها الخلاف باستثناء تلك المسائل التي تؤدي إلى مفسدة أو فتنة فإن له الإنكار .

Some scholars abuse of using the base of (no disapproval in disagreement issues) - it means that to conclude in the matter that accord its inclinations-this lead to many blights .

They must explain when it would be deducted when it would be correct?

3 - This subject also show up the measure of the understanding of the (Figh) disagreement issues for to confess or to deal with .

4 - some scholar abuse the Base and No Disapproval in Disagreement conclude in matte «Issues» to Its Inclinations that this Lead to many Blights Accord This land to many Blights Accord they must Explain When it deduction? and when it would be correct .

2- Explain the meaning of the disapproval - it is legislated and its degrees .

3- Explain the definition of controversial and jurisprudence issues .

4- Explain the reasons and the rules that would be Observe in disagreement .

5- Explain of the disagreement issues sections and The rule of disapproval .

6- Explain the situation of the teller from the disagreement issues .

Research Methodology :-

This research follow the inductive and analysis method-that to return for the resources which discussing the subject and try to understand it dimension-analysis and discussing the view of the scholar to reach for truth and the real .

Main Results :-

1- The important of the knowledge of the scholars disagreement-the man who research about this earning many benefits .

2- The disagreement between the scholars is God .

Preordination exist and that is not arising from deviation or inclination .

3- The well saying is :- there is no complete wrong or correct for the diligent . (in the disagreement issues) .

The real is one, who hit a target having two rewards and who missed it having one reward, there is no sin for each of them .

4- The issues that sub-permitted to disagreement

Disapprove for correct saying-accepting the consensus .

5- The issues that allowed to disagreement-there is no disapproval for who said the correct-the best way is advisory, discussion and debate .

6- If the disputers in the same country and under the same Imam-they must accept by the ideology Of their Imam .

7- They must formulate the rule of (no disapproval in disagreement issues-in the same phrase (no disapproval in opinion) .

8- The letter in the issues that sub-permitted to the disagreement-that if the saying support by a proof, accepting his idea-having the disapproval .

9- If the saying supporting by the proof and by disagreement shown his idea-have no disapproval .

There is no right for the letter to disapproval in the issues that allowed to disagreement and accept for the issues that lead to evil or appeal herewith having the right of disapproval .
